1. Introduction

Welcome to LetterCraft. These Terms of Service (“Terms”) govern your use of our services, including custom-printed letters, stationery, and associated services. By placing an order with us, you agree to abide by these Terms.

2. Order Acceptance and Refusal

2.1 Right to Refuse Orders

LetterCraft reserves the right to refuse any order at our sole discretion. Orders may be refused if they:

  • Contain content that promotes violence, war, systemic discrimination, or human rights violations, as defined by international human rights standards.
  • Advocate for policies that are inconsistent with LetterCraft's ethical values, including but not limited to the promotion of military aggression or systemic discrimination.
  • Violate Australian or Victorian laws, including hate speech laws under the Racial Discrimination Act 1975 (Cth) or defamation laws under the Defamation Act 2005 (Vic).

2.2 Political Content Policy

We accept political letters at our discretion and do not guarantee acceptance. If you submit political content, you must indicate this during the ordering process.

LetterCraft does not print materials that:

  • Directly promote political parties, candidates, or policies that contradict our ethical guidelines.
  • Advocate for military actions, occupation, or policies that promote systemic discrimination.
  • Engage in false or misleading political messaging in breach of the Commonwealth Electoral Act 1918 (Cth).

However, we do not discriminate based on political affiliation and will assess each order based on its content, not the identity of the customer.

3. Legal Compliance for Political Messages

3.1 Electoral Authorisation Requirements

Under the Commonwealth Electoral Act 1918 (Cth) and Victorian Electoral Act 2002 (Vic), printed materials that promote or oppose political parties, candidates, or policies must include an authorisation statement.

3.2 Customer Responsibility

If your order qualifies as a political message, you are responsible for ensuring compliance with these laws.

You must provide an authorisation statement including:

  • Name of the person authorising the content
  • Name of the organisation (if applicable)
  • Physical address (no PO Boxes)

This information must be included at the bottom of the letter. LetterCraft reserves the right to reject any political content that does not meet legal requirements.

4. Content Restrictions

4.1 Prohibited Content

We do not print materials that contain:

  • Hate speech (as defined under the Racial Discrimination Act 1975 (Cth) and the Racial and Religious Tolerance Act 2001 (Vic)).
  • Defamatory content under the Defamation Act 2005 (Vic).
  • Misinformation or deceptive content that violates the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

4.2 Discretionary Content Rejections

LetterCraft reserves the right to reject content at our sole discretion if we determine that it:

  • Conflicts with our ethical business values.
  • Is likely to cause public controversy, harm, or reputational damage.
  • Requires legal review beyond our capabilities.

5. Customer Acknowledgment & Liability

5.1 You Acknowledge That:

  • You are solely responsible for the content and accuracy of your order.
  • LetterCraft is not liable for any legal consequences arising from the printing, distribution, or use of your letters.
  • If your content is found to be in violation of Australian law, we reserve the right to provide information to relevant authorities as required.

5.2 Indemnification

By using our services, you indemnify LetterCraft from any claims, damages, or legal fees resulting from your order's content, publication, or distribution.

6. Order Process & Payments

6.1 Order Submission & Approval

  • All orders are subject to manual or automated review before approval.
  • Orders flagged for compliance checks may require additional information or authorisation statements.

6.2 Payment & Refund Policy

  • Payments must be made in full before printing.
  • If we reject an order due to content policy violations, a full refund will be provided.
  • If an order is cancelled after approval but before printing, a partial refund (minus processing fees) may be issued.

7. Privacy & Data Protection

  • Customer data is protected in accordance with the Privacy Act 1988 (Cth).
  • We do not share order details with third parties unless legally required.

8. Amendments & Updates

We may update these Terms at any time. The latest version will be available on our website. Continued use of our services constitutes acceptance of any changes.
